General Sales Conditions

 

These sales conditions apply to all sales agreements between Airsoft Store and the customer. Deviations from these general sales conditions can only be made by a written document, signed by Airsoft Store and the customer. These general terms and conditions of sale completely exclude all general terms and conditions stated in documents from the customer, even if these documents are of a later date. Airsoft Store reserves the right to change the general terms and conditions at any time and / or supplement them for future orders without informing the customer personally and without the latter being able to claim any compensation.

 

2. Reservation and payment in the store

The customer has the possibility to reserve a product. The customer will be notified when the product can be picked up at the selected Airsoft Store store.​

The customer only decides whether or not to purchase the products; if not, the deposit paid is not recoverable by the customer or third parties.

In the event of a purchase, the customer pays at the Airsoft Store checkout. Only at that point is a sales agreement concluded. Therefore, this is not a distance sale and, consequently, there is no right of withdrawal (see point 9). The customer can pay a deposit on a product; at this point, a temporary purchase agreement is made, but this is not yet a sales agreement. Once a deposit has been paid, the price of the ordered/reserved item/product for that day applies.

All reserved goods must be collected within two weeks of the goods becoming available (if the goods were not available at one of the Airsoft Store locations), or upon receipt of payment. After this period, the deposit paid and the reservation will be forfeited. Consequently, this deposit can no longer be deducted from the final sale of the goods.

The deposit only applies to the ordered/reserved item and cannot be transferred to another product. If the customer ultimately decides not to purchase the product, at least the deposit paid will be deducted from the total price of the amount paid for reserving these products.

In the event of non-sale of the reserved property within 14 days of receipt of the deposit/reservation amount, there is no possibility for the customer or third parties to recover this deposit/reservation amount.

When a payment link is forwarded, the words "reservation" or "deposit" can be included in the message, as well as other words that can indicate that this is a reservation and the payment is a deposit.

Airsoft Store reserves the right to refuse orders or reservations if:

• there is a serious suspicion of bad faith or intent to defraud;

• there is repeated abuse of the right of withdrawal;

• there are suspicions of repeated abuse of rights or fraud by a customer;

• incorrect, suspicious or wrong customer data is provided;

• it is established that a person provides fictitious personal data on multiple occasions;

• an abnormal quantity of an ordered quantity is found – possibly in different purchase orders – which goes beyond purely personal use;

• it can be assumed that orders were placed for resale;

• there is a case of force majeure. The reserved products will remain available to the customer at the Airsoft Store for one month from the date of the reservation. If the customer does not collect or pay for the reserved products, the reservation will automatically be canceled after one month, unless otherwise agreed with the customer in writing or by email.

Please note that a reservation means that these goods are made available to a specific customer. If this was the last product (the specific product) in stock, and it can no longer be sold to others due to this reservation, and the customer cancels the reservation, Airsoft Store will suffer damages due to unsaleability. The reservation fee is therefore non-refundable. A service is also provided to prepare the products. If the customer cancels this reservation, administrative costs for this service may be charged. If it turns out that the customer does not meet the sufficient requirements for purchasing certain goods, the deposit is non-refundable and does not entitle them to claim any form of compensation or damages.

 

3. Delivery or collection of an order

 

Deliver

 

Delivery to the customer will be made to the address of the customer's choice after receipt of payment. The customer has a 14-day right of withdrawal (see point 8). If delivery of the ordered goods is delayed, Airsoft Store reserves the right to change the sales price. This sales price will be adjusted if the purchase price, taxes, duties, or levies payable by Airsoft Store change between the date of order acceptance and the date of scheduled delivery. Please note: This is an order with payment obligation.

CPT incoterms apply unless otherwise decided by the seller.

Carriage Paid To - Freight free until

means that the seller pays the freight charge for transporting the goods to the said destination. The risk of loss of or damage to the goods, as well as that of any additional costs resulting from events that occur after the goods have been delivered to the carrier, transfers from the seller to the buyer from the moment the goods arrive at the first carrier have been transferred. If successive carriers are used for transport to the agreed destination, the risk passes when the goods have been delivered to the first carrier.

The term CPT obliges the seller to clear the goods.

 

Pick up

 

When a customer orders an item from the webshop at airsoftstore.be and chooses to collect it from an Airsoft Store in Belgium (pickup@store), it will be ready for collection a few days later, depending on availability, at an Airsoft Store in Belgium of their choice. The customer checks the product and then decides whether the sale is approved or should be cancelled. If the customer takes the goods with them, this is not a distance sale and therefore has no right of withdrawal (see point 10). If the goods are not collected by the customer after two electronic messages or emails, Airsoft Store is entitled to cancel the order or consider the agreement terminated within one month. Please note: This is an order with a payment obligation.

 

4. Price and available information (description/images)​

 

Unless otherwise stated in the agreement, prices include 21% VAT, Recupel, and other taxes. For online orders from other countries, the relevant VAT rates are calculated and appear on the invoice. The invoice amount is the correct price, which must be paid before the sale can proceed.

Additional mandatory delivery, ordering, or other administrative costs are not included and are listed separately. All prices are in Euro/€. All prices are based on Cash & Carry. Additional services (delivery, installation, financing, etc.) are therefore not included, and products can only be delivered upon payment of additional costs. Items purchased from the Airsoft Store webstore must be paid by the customer before delivery. No delivery or order will be placed until the full purchase price has been paid. The price, including any delivery costs, must therefore be paid in full before delivery. A "distance selling" agreement is only concluded when an order is handed over to the consumer or sent by email to the email address provided by the customer. Promotions and special offers are only valid while supplies last. Airsoft Store cannot be held liable for the consequences of typographical or printing errors in prices or items, deviations in images, or interim changes to designs. Colors may vary due to production processes. If you require a true-to-color image, we can send you a photo of the product you are interested in. To do so, please send us an email to helpdesk@airsoftstore.be. Airsoft Store reserves the right to adjust orders to the correct applicable price or to unilaterally cancel them if it appears that the price indications and/or product descriptions of (a) product(s) and any combined options on the website are incorrectly indicated due to a technical or human error. This applies both online and in physical stores (based on price tags on the product). Payment for online orders can be made using various online payment methods. Airsoft Store accepts cash payment upon pickup in-store, not upon delivery. Electronic and paper gift cards can be used, in accordance with their validity period from the date of issue. If the order amount exceeds the amount of the gift card or gift voucher, the customer must pay the difference. If the order amount is less than the amount of your gift card or gift voucher, the customer will retain the balance as a credit.

 

5. Terms of Delivery

CPT Incoterms are maintained unless the seller decides otherwise.

The term CPT obliges the seller to clear the goods only for export. Import is at buyers risk and expenses

Ordered products will be delivered subject to available stock. Deliveries are carried out by various external partners, depending on the size of the ordered product(s) and the services selected by the customer. The driver or carrier may request proof of identity upon delivery. The customer signs for the delivery by signing a delivery note. If the customer is not present at the time of delivery of small or medium-sized products, the carrier will leave a notice in the mailbox indicating the local post office. Upon presentation of proof of identity, the customer can collect the product from the local post office within 14 calendar days. For large-sized products and products requiring installation, our specialized delivery partner will contact the customer to arrange a new delivery date. In the event of a re-delivery due to the customer's absence, Airsoft Store reserves the right to charge any costs incurred. If a goods lift is required, a surcharge of €100 will be invoiced upon delivery.

 

6. Delivery time

 

Delivery times are not an essential element of the sales agreement. Unless a different delivery time has been agreed upon, for example, in the case of a pre-order, order, or out-of-stock situation, Airsoft Store will deliver the products no later than 30 days after the conclusion of the agreement. If Airsoft Store cannot meet this deadline, an additional period, appropriate under the circumstances, will be agreed upon with the customer.

 

7. Pick up in store

 

Products for collection will be delivered to the Airsoft Store store chosen by the customer as the collection point. The customer agrees to present their identity card or passport upon collection. Airsoft Store reserves the right to release goods only upon presentation of a valid identity card or passport, accompanied, if necessary, by a signed and original authorization from the person in whose name the order was placed. In principle, the identity card must be presented for the natural person who placed the order, or for the legal representative in the case of an order placed by a legal entity. The products will remain available for 14 calendar days, after which the order will be canceled. To prevent payment fraud and to detect this in the event of a judicial investigation, Airsoft Store reserves the right to take a copy of the identity card or proof of identity.

 

8a. Transfer of ownership

 

Ownership of the delivered goods passes from Airsoft Store to the customer upon receipt or delivery of the goods to the customer and full payment of the price. Notwithstanding Article 1583 of the Civil Code, the sold, delivered, or installed goods remain the exclusive property of Airsoft Store until full payment of the invoice. Until the sales price has been paid, the customer is prohibited from pledging the goods or offering them as security in any way whatsoever. The customer is expressly prohibited from modifying these goods, making them immovable by incorporation or destination, selling them, or disposing of them in any way whatsoever. As long as Airsoft Store, in accordance with the provisions of this clause, retains ownership of the delivered goods, the customer remains responsible for maintaining them in good condition. During this period, the customer will be solely liable for any loss of or damage to the goods. The customer agrees to insure the goods against all risks. The customer also agrees to arrange the storage of the goods in such a way that any confusion with other goods is excluded at all times and that they can always be identified as the property of Airsoft Store. Any payment by the customer will first be deducted from the outstanding amounts owed for goods modified or sold by the customer in violation of this article.

8b. B2B payment methods

  • The Client is obligated to pay all amounts due under the Agreement within 30 calendar days of receipt of the invoice from DV Europe CVBA at the registered office of DV Europe CVBA, unless otherwise agreed in the Special Terms and Conditions. Official notice of default will be issued automatically on the 31st calendar day after the invoice date. Interest on the outstanding amount may accrue later, calculated daily, either immediately upon request by the Client or at a time determined by DV Europe CVBA, taking into account the date of the Client's request.
  • In the event of late payment of any amount due under the Agreement or for any other reason, DV Europe CVBA shall be entitled to suspend all deliveries and take back the delivered Goods.​
  • In the event of late payment of any amount due under the Agreement or for any other reason, DV Europe CVBA is automatically entitled to compensation of 10% of the outstanding amount (with a minimum of €120.00) as well as a contractual default interest at the interest rate determined in accordance with the statutory interest rate, which, if the Customer is a company, is determined in accordance with the Act of 2 August 2002 on combating late payment in commercial transactions. This is currently 8% per annum and is calculated in weeks by DV Europe BV.
  • The Customer waives its right to suspend payment of amounts due in the event of its own claim or complaint and thus waives the exception of non-compliance.
  • All delivered Goods remain the full property of DV Europe CVBA until full payment of all claims of DV Europe BV, including principal, costs, and interest, under the Agreement and/or any previous or subsequent agreements of the same nature, as well as any damages against the same Customer or its affiliated companies. Any risk of damage to or loss of the Goods is borne by the Customer.​
  • As security for all its obligations, on whatever grounds, both contractual and non-contractual, towards DV Europe BV, the client grants a pledge on all its current and future claims against third parties, on whatever grounds, such as, but not limited to, trade receivables, compensation for performances and services, and claims in contractual and non-contractual liability.​
  • If an order for delivery or performance of work is placed on behalf of two or more natural or legal persons, these persons shall each be jointly and severally liable for the full fulfilment of the obligations arising from the Agreement.​
  • In the event of termination of the contractual relationship, DV Europe BV may offset all mutual claims with the Client, regardless of the time at which the claims in question become due, in accordance with the provisions of Article 14 of the Financial Collateral Act of 15 December 2004.
  • Late payment of an invoice will cause all outstanding invoices to be forfeited, even if the due date of those invoices has not yet passed.​
  • The submission of an account statement by DV Europe BV is sufficient to determine the amount of its claim against the Customer (including delivery of the Goods and Services) and to provide proof thereof.

 

9 a. Right of withdrawal (cooling-off period) right to cancel (only valid on online orders, not on purchases in physical stores) (not for companies / legal entities)

 

The customer has the right to notify Airsoft Store of their decision to cancel the purchase, without penalty and without giving a reason, within 14 calendar days from the day following the date of the sales contract. The contract can only be terminated if the seller has taken NO action (any action related to this order). If the seller has already taken action, the only applicable legal action is the "Right of Return/Withdrawal."

Right of withdrawal

The customer has the right to inform Airsoft Store of their decision to cancel their purchase (online purchases only), without penalty and without giving a reason, within 14 calendar days of the day following delivery of the item. A refund will only be issued once the goods are returned to Airsoft Store (goods returned to an Airsoft Store location).

The right of withdrawal does not apply to legal entities or to products purchased by a natural person for professional use (online & offline). To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement. The burden of proof for exercising the right of withdrawal lies with the customer.

Packages may only be opened if the product is not visible without opening it.

The right of return only applies if a product can be viewed and inspected in a physical store. Any other use is not permitted.

Not everything needs to be visible; the inside of a product isn't required. Examples include a grip or gearbox.

Products whose specifications, characteristics, and nature are already fully clear from the information on the packaging must not be opened. The required characteristics are brand, type, type, model, and color.

The customer is liable for any diminished value. The criteria for diminished value are resalability in new or good condition.

Checking the functioning and if it does not work does not fall under the right of withdrawal but under non-conformity and this only when a product has a standalone functioning.

Functionality testing is ONLY permitted if the product is not intended to be installed in a replica, resulting in damage. For example, paint chipping and scratches are considered damaged goods and are not covered by the right of withdrawal. Therefore, Airsoft Store offers a technical service to perform this. You do pay for this service, but if an item is incompatible with another, the customer will be notified to adjust it if necessary. The purchase price for the initial product is waived in this case; only the installed product will be charged.

The right of withdrawal only applies to products with accessories, instructions, invoice and proof of purchase included.

Products that are not in this condition upon receipt by Airsoft Store will remain available to the customer. The availability period is one month, after which Airsoft Store becomes/remains the owner of the product, without the customer being entitled to any form of compensation, restitution, or reimbursement for the goods. They therefore remain available to the customer for this period, and the customer can collect them or have them shipped back to them (at the customer's expense). If the customer exercises their right of withdrawal, the customer must return or return the products to Airsoft Store by any means and at their own risk and expense. Shipments "carriage paid by the recipient" and "cash on delivery" will be refused.

Returned purchases that fall under the "free shipping" policy will still be charged at the applicable shipping rates. This also applies to orders where products are canceled at the customer's request, meaning the total purchase price no longer falls under the free shipping policy. For large products, Airsoft Store can collect them at the customer's express request. The customer will be billed for €50 in shipping costs. Alternatively, the customer can drop off the product at the reception desk of an Airsoft Store store, free of charge.

The right of withdrawal does not apply to the following articles:

  • Installed, damaged or incomplete items;
  • Items that have a clearly personal character;
  • Delivery of products that spoil quickly or have a limited shelf life;
  • Items that are sealed and of which the seal has been broken or removed and the packaging has been opened in some way or shows indications of this.
  • Products which are not suitable for return due to health protection or hygiene reasons and whose seal has been broken after delivery;
  • Items that can no longer be returned due to their nature;

The customer, or the customer's designated party other than the carrier, must exercise their right of withdrawal within 14 calendar days from the day following delivery or physical possession of the product, by registered letter or email (helpdesk@airsoftstore.be), and provided that the customer returns the products, within 14 calendar days from the day of exercising the right of withdrawal or the notification. The customer cannot return the product to the reception desk of an Airsoft Store, as everything must be done online. In the case of multiple deliveries of a single order, the 14-day withdrawal period begins from the physical possession of the last good. In the case of multiple deliveries of a single order of a single product, the 14-day withdrawal period begins from the physical possession of the last part of that single product.

Airsoft Store reserves the right to withhold reimbursement until the product(s) have been received, or the customer has demonstrated that all products have been returned. In that case, Airsoft Store will only accept proof of registered mail from the shipping company and a photo of the product and the package. The customer will voluntarily provide the package number upon request so that it can be verified by the shipping company. The balance will then be refunded within 14 calendar days of receipt of the products, as described above (less depreciation and shipping costs if the original purchase fell under the free shipping policy and, after the return, the subtotal falls below the "free shipping" amount).

The refund will be made using the same payment method as the original payment. Airsoft Store reserves the right at any time to deduct the amount of the product's depreciation, for which the customer is liable, from the purchase price to be refunded.

Additional delivery costs, if the customer has expressly agreed to a delivery method other than the cheapest standard delivery offered by Airsoft Store, will not be refunded. If Airsoft Store suspects this is being done in bad faith (large orders, etc.), Airsoft Store will request a non-refundable deposit if the customer exercises their right of withdrawal.

For returns, the original product packaging must NOT be used as a shipping box, otherwise an administrative fee of €10 will be charged.

9 b. Order not received or not yet received.

It's always possible that an order hasn't yet arrived at its destination. Please be patient in this case; sometimes shipping companies experience busy days, and delivery may experience slight delays.

On the other hand, it is possible that a package gets lost, in which case the track and trace code will be checked (if it has been delivered or not).

If the track and trace status shows "delivered," it may have been delivered elsewhere due to unforeseen circumstances (perhaps to a neighbor or a collection point). If this isn't the case, please feel free to contact us.

We will then contact the shipping company and they will start an investigation into this.

You will also receive an email with a form to complete. This is a legally binding declaration of non-receipt of the package. False declarations will result in immediate prosecution.

Only when the investigation is completed will the decision be communicated to us.

Please note that in some cases, it can take months after the investigation begins to be completed. Once it's completed and the investigation reveals the package is lost, the shipping company will contact the insurance company. They will then release the value of the package. Only once this has been confirmed and payment has been made to us will a refund be issued. Not before.

We're monitoring everything, but we won't send a weekly email to customers unless there's any news. We'll let you know as soon as we receive more information.

Since this can take several months to complete, it can be frustrating for customers. We fully understand this, but we are following the proper procedure.

 

Packages are expected to be delivered within two weeks within Europe. If you haven't received your package within three weeks, please let us know as soon as possible.

If you notice that the tracking code hasn't been updated for about 5 days, we recommend contacting us as soon as possible to investigate.

We can submit an investigation request to the shipping company no later than 30 days after shipment.

After 30 days it is deemed to have been delivered and nothing more can be done.


9 c. Uncollected package.


If the shipping company attempts delivery but is unable to do so due to unforeseen circumstances, your order will usually be sent to a parcel point. You will have a specific time to collect it there. If the parcel is not collected and is returned without receipt, we will still charge the original shipping costs. Your right of return only applies if you have actually received the parcel.

 

 

10. Right of termination

 

In the event of the customer's insolvency or outstanding debts, even under previous agreements between the customer and Airsoft Store, Airsoft Store is entitled to suspend the performance of its obligations until the customer has paid all outstanding debts to Airsoft Store in full. If the customer fails to pay within 7 calendar days of the due date of any invoice, Airsoft Store is entitled, by operation of law and without prior notice, to consider the agreement terminated, while retaining its right to claim interest and/or damages.

 

11. Claims

 

When purchasing demonstration products/showroom models, the customer accepts that visual or other defects may be apparent. The customer will receive a discount as stated by Airsoft Store, which implies that the customer acknowledges that they are aware that these defects (visible damage or defects) may occur in such products. This means that the customer waives their right to subsequently hold Airsoft Store or its carrier accountable for any visible damage or defects thus identified. The above does not affect the customer's statutory warranty rights, as also described in Article 12.

 

12a. Warranty

 

12.1. Airsoft Store offers a 24-month warranty for defects in accordance with the contract, not on wear and tear parts, and only when the product has been regularly maintained by our service department. The warranty period commences on the date specified in Article

12.2. The date stated. This warranty covers the repair or sending of the goods to the relevant supplier or manufacturer. The goods can only be exchanged if the goods were sent to the relevant supplier or manufacturer and were declared unrepairable or if the repair would take more than three months. If the goods are irreparable, the defective goods can be replaced at no cost to the customer. However, if it turns out that repair or replacement is impossible, disproportionate to Airsoft Store, or would cause significant inconvenience to the customer, Airsoft Store agrees, at the customer's request, to grant the customer an appropriate price reduction or, as the case may be, to terminate the agreement and refund the price (after the appropriate price reduction), provided the customer returns the goods. After receipt of delivery, all claims for non-conformity must be submitted in writing within one week of receiving the goods in question, otherwise the right to bring such a claim will be forfeited.

12.2 Only the original invoice, receipt, or purchase receipt you received upon purchase can be considered proof of warranty for the customer with Airsoft Store (and must still be legible). If these proofs of purchase are missing, the warranty cannot be granted. Proof of payment will not be accepted as valid proof of purchase, as they do not contain any products. The customer must keep and present these documents in their original form. Airsoft Store cannot be held liable for the loss of these documents. The warranty period begins on the date stated on these documents. If delivery to the customer occurred before the invoice date, the delivery date stated on the delivery document applies.

12.3 This warranty does not apply to parts or accessories if the defect results from improper use, external causes, routine maintenance, or normal wear and tear. It is recommended that you discontinue use of this product if abnormal performance is observed. If it is determined that the product has been used in this condition and the damage has exponentially increased as a result, the warranty will also be void due to misuse of the product.

12.4 This warranty does not apply in the following cases (the list below is not exhaustive): if a third party, not lawfully authorized by Airsoft Store, has intervened in repairs/opening; in the event of damage caused by fire, water (flooding), lightning, accident, natural disaster, or environmental influences; in the event of damage caused by improper use, poor maintenance, abnormal use, or any other use that does not comply with the manufacturer's or seller's instructions; in the event of damage resulting from or by commercial, professional, or collective use of the product. Each Airsoft replica must be serviced every three months or after 100 hours of operation (if these hours were reached within a three-month period) by either the Airsoft Store technical department or an authorized distributor who can provide a maintenance receipt (with a detailed description of the maintenance and the products used) in order to remain within the warranty conditions until the statutory warranty expires.

12.5. Defective goods must be completely empty upon return. At the customer's express request and to the extent possible, the items blocked in the defective goods will be returned to the customer, provided they were listed on the repair receipt at the time of return or delivery of the repaired or replaced goods. Airsoft Store is in no way liable for the condition in which the blocked items are returned to the customer. In the event of damage, theft, or loss of goods returned for repair, Airsoft Store's liability to the customer is limited to the sales price of the goods, minus the damage determined by Airsoft Store. If specific spare parts or accessories necessary for the repair of the goods are no longer available from the manufacturer, Airsoft Store is not liable for the (partial or complete) loss of the goods' usability, without prejudice to the other provisions of Article 12, in particular Article 12.1. When repairing electronic devices, it is possible that data stored in or by them may be damaged or lost. The customer is solely responsible and liable for the preservation of this data or for reinstalling it, excluding any liability of Airsoft Store in this regard. Airsoft Store accepts no liability for the loss or reproduction of data stored in or by such electronic devices. The warranty period for exhibition/used models, as well as for professional customers, is 12 months.

12.6. Product compatibility is not covered by the legal warranty. These products, due to their incompatibility, cannot be classified as non-compliant or claimed as defective if they function independently. A product is considered compliant if its function is considered in isolation and is functional (i.e., not as part of a whole or combination of products, unless these products are classified as spare parts or components).

The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the article, rough handling, poor maintenance, or any other abnormal or incorrect use.

Defects that manifest themselves after six months from the date of purchase, or delivery if applicable, are not considered latent defects, unless the Customer can prove otherwise. The consumer must provide proof that the defect already existed at the time of delivery/purchase, up to six months after purchase/delivery. After six months, the customer must provide proof that it is a manufacturing defect. Regular maintenance of the product by our service team (if applicable, such as with replicas) can help you provide the necessary evidence.

 

12b. Maintenance of replicas

After every airsoft session, it's important to thoroughly clean your replica. Start by removing any mud, dust, sand, or other debris that can accumulate on the surface and inside the barrel. Use a soft cloth and a mild cleaning solution to wipe down the exterior. For the inside of the barrel, you can use a specially designed barrel cleaner or a cleaning swab.

*. Lubrication of Movable Parts

One of the most important aspects of maintaining an airsoft replica is lubricating its moving parts. 13. Risks of the Internet

 

The customer is aware of the limitations and risks of using the internet or any other medium through which the website is made available now and in the future. The customer is also aware of the risks of storing and transferring information digitally or electronically. The customer accepts that Airsoft Store is not liable for any damage resulting from the use of the Airsoft Store website or the internet as a result of the aforementioned risks. The customer accepts that electronic communication and backups can serve as evidence.

 

14. Requests for reimbursement of paid VAT

 

All requests for VAT recovery or refunds on purchased goods by non-EU residents or diplomats, as well as verification of the legal requirements for reimbursement, should be directed exclusively to external specialized partners designated by Airsoft Store. The customer agrees to comply with the applicable terms and conditions of these partners. More information about these partners is available upon request.

 

14b. VAT for companies

The VAT payable depends on the delivery address. If the delivery address is in Belgium (even if you pick up your order), you must pay Belgian VAT, even if your VAT number is from another country. If the VAT number and delivery address are in another country, the VAT is reverse-charged.

This is only calculated on the website when the delivery address has been entered.

For goods that fall under the Firearms Act and are therefore not permitted to be shipped, the customer company must possess the necessary permits. Proof of this must also be provided. Only after this, we can authorize the sale. Please note that because the system does not automatically provide this option for shipping permit-required goods for companies, this is done manually within our company.

 

15. General provisions – competent courts

Should any article of these terms and conditions be invalid or void, or be declared invalid by a competent court, this will not affect the validity of the other articles of these terms and conditions, which will remain in full force. The Client grants permission to DV Europe BV to make visual material (photos, videos, etc.)​

of the Services performed and/or the Goods delivered to the Customer. DV Europe BV may do this​

incorporate images into marketing materials (brochures, flyers, etc.) and publish on her

website and social media pages (Facebook, Instagram, etc.)

17. Any complaints or disputes

 

Airsoft Store attaches great importance to the correct, transparent, and careful handling of complaints and disputes. To ensure this, consumer complaints and disputes are handled exclusively through our helpdesk.

The employees in our physical stores are not involved in the administrative follow-up of files and do not have the necessary information, authority, or access to substantively handle complaints or disputes or consult their status.

We cannot substantively address complaints or disputes submitted verbally in-store or through other communication channels. By using the email address above, your complaint can be correctly registered and followed up, enabling efficient and clear communication.

Airsoft Store strives to respond substantively to every complaint within 14 calendar days of receipt.

 

18. Delivery of incorrect goods

 

If Airsoft Store delivers an incorrect product or order due to human error, Airsoft Store will guarantee the delivery and cover the return costs. The original product or order will be refunded, allowing you to place a new order. Refunds for the goods and return costs will be processed once everything has been successfully processed (products checked and shipping information is passed on to our accounting department). This takes time, but is always handled as quickly as possible. The shipping costs for the original shipment will not be refunded if it does not cover the entire order.

This procedure gives the customer the full right to either reorder or purchase these products from another company. Involuntary customer loyalty is prohibited by law. This procedure is designed to comply with this law.

 

19. Checking the goods of the received online order and/or checking products when purchasing in the physical store

Received goods must be inspected for visible damage and proper functioning within two calendar days, and any non-compliant items must be reported within those two calendar days. After that, the goods are automatically considered to have arrived/received in good condition and are functioning properly. The initial use and testing of a product can already leave some signs of wear, making it no longer in new condition. (A brief example from another industry is buying a car and using the brakes for the first time. This already leaves signs of wear and tear, and the seller can no longer be held responsible for not being new.)

When a package arrives, the customer must check the packaging for any damage and take a photo. This must be done upon receipt. All corners of the packaging must be photographed. These are then checked by the airsoft store against our video files of the packing process. All orders are prepared by Airsoft Store, and the entire packing process of all products is carefully recorded in a video file, including the order number. This is to substantiate claims for undelivered or incomplete products. If a product in the order is found to be incomplete by the customer, a video surveillance inspection will be conducted. Original packaging is opened by airsoft store employees to check if all the parts are inside.

In the event of product damage, an investigation is always initiated and a damage claim is filed with the shipping company. It can take some time for them to process and finalize this file. Only after this, and if approved, can a potential damage claim be recovered. You won't simply receive a different product.
